LMOGA Statement on Governor Landry Signing Louisiana Energy Protection Act into Law

PORT FOURCHON — Louisiana Mid-Continent Oil and Gas Association (LMOGA) President Tommy Faucheux released the following statement celebrating Governor Jeff Landry signing into law the Louisiana Energy Protection Act. The legislation authored by State Representative Brett Geymann (R-35), chairman of the House Natural Resources and Environment Committee, shields Louisiana energy producers, users, and businesses at large from politically motivated lawsuits seeking speculative damages allegedly caused by global climate change.

“This legislation was an important step to prevent the national trend of climate change lawsuits from coming to Louisiana while also chipping away at our state’s own destructive litigation climate," said Tommy Faucheux, LMOGA President. "The Louisiana Energy Protection Act is one of the legislature's signature accomplishments from this past session."

The Louisiana Energy Protection Act prohibits any claim for damages filed after the date of enactment that includes allegations that a defendant caused, contributed to, or was responsible for climate change. The legislation does not provide blanket immunity from claims of any kind. However, it does require plaintiffs to identify specific legal or permit violation beyond a vague allegation of climate change causation.

This commonsense legislation echoes similar successful effort in Utah, Oklahoma and Tennessee, enabling future growth and keeping Louisiana competitive for new investment.
